US judge blocks trump order on birthright citizenship

A federal judge temporarily blocked President Donald Trump’s executive order denying U.S. citizenship to children born to parents living in the country illegally.

Judge John Coughenour called the order “blatantly unconstitutional” during a hearing on Thursday.

The executive order, issued on Trump’s first day of his second term, aims to deny citizenship to children born after 19th 0f February to undocumented parents and prohibits federal agencies from recognizing their citizenship.

This move has faced immediate legal challenges from 22 states and immigrant rights groups, with Washington, Arizona, Oregon, and Illinois filing the first lawsuit to reach a hearing.

Coughenour’s decision halts the implementation of the order for 14 days while further arguments are presented.

He emphasized the clear unconstitutionality of the order, citing the 14th Amendment, which guarantees citizenship to all individuals born on U.S. soil.

The Department of Justice defended the order, arguing it provides a correct interpretation of the 14th Amendment.

However, state attorneys and immigrant rights advocates countered that the order violates long-standing legal precedents, including the Supreme Court’s 1898 ruling in Wong Kim Ark’s case, which affirmed birthright citizenship for children born to immigrants in the U.S.

Washington Attorney General Nick Brown stressed the urgency of blocking the order, as it could disrupt healthcare and benefit systems nationwide while stripping citizenship from potentially hundreds of thousands of individuals.

The court scheduled a follow-up hearing on February 6 to determine whether to extend the block on the order.
