TikTok to make final plea at supreme court against US ban

TikTok will appear before the US Supreme Court on Friday in a final attempt to overturn a ban that would force the popular social media platform to separate from its Chinese owner, ByteDance, or face being blocked from the US by 19th of January 2025.

The case is testing the balance between national security concerns and free speech rights.

The US government argues that without a sale, TikTok could be used by China for espionage and political manipulation.

In contrast, TikTok denies these claims, asserting that it has been unfairly targeted and that the law violates the free speech rights of its 170 million American users.

Lower courts have sided with the government, but the involvement of President-elect Donald Trump has added complexity, as he has called for the law’s enforcement to be paused to allow time for a potential deal.

The legislation, passed with bipartisan support, does not ban the app itself but would require companies like Apple and Google to stop offering it, effectively phasing it out.

Many countries, including the UK and India, have already banned TikTok from government devices or imposed complete bans.

TikTok has argued that the law is based on flawed and hypothetical information and has asked the Supreme Court to strike it down.

The American Civil Liberties Union and Freedom of the Press Foundation have joined the dispute, contending that the US government has not provided credible evidence of harm caused by the platform.

While the case pits national security against First Amendment rights, experts suggest that the government may ultimately prevail, as close cases often favor national interests.

A decision from the Supreme Court could come within days, potentially setting a precedent on how free speech and security concerns are balanced in the digital age.
