IVF donors hold no legal rights over child


It has been confirmed that the biological parents of a child born to the wrong family through IVF implantation cannot obtain legal rights under Queensland law.

A woman was recently reported to have unknowingly given birth to another couple’s child at a Monash IVF clinic.

The parents of a baby born in February have requested that their remaining frozen embryos be transferred to another provider.

Accordingly, the woman has been forced to give birth to a child that is not biologically theirs after her embryo was accidentally thawed, leaving her with a baby that is not biologically theirs.

Legal experts have stated that the law recognizes the birth parents as the legal parents of the child.

They say there is a law to protect parents from legal issues that may arise with egg or sperm donors during the IVF process.

This law was introduced last year.
