Fundamental rights petitions seeking annulment of SL–India MoUs dismissed

The Supreme Court on 4th of August dismissed two fundamental rights (FR) petitions seeking to annul seven recently signed Memoranda of Understanding (MoUs) between the Governments of Sri Lanka and India.

The petitions were dismissed without examination after a lengthy consideration by a bench comprising Justices Achala Wengappuli and Priyantha Fernando.

The petitions were filed by a group including Dr. Gunadasa Amarasekara, President of the Patriotic National Movement.

The Attorney General, Prime Minister Dr. Harini Amarasuriya, and the Cabinet of Ministers were named as respondents in the case.

The petitioners argued that the MoUs violate the Constitution and international law, and were signed without public disclosure or parliamentary approval.

They claimed that this lack of transparency infringed upon citizens’ constitutional rights and undermined Sri Lanka’s sovereignty and territorial integrity.

The petitioners also requested an interim injunction to prevent the implementation of the MoUs and sought Rs. 2 million in compensation for the alleged violation of their fundamental rights.

However, the Supreme Court ruled that the petitions would not proceed to further examination and dismissed them.
