Fundamental rights petition filed to annul SL-India MoU

A Fundamental Rights petition has been filed in the Supreme Court seeking to annul the recently signed Memoranda of Understanding (MoUs) between Sri Lanka and India.

The petition, submitted on Wednesday (07) by a group including Dr. Gunadasa Amarasekera, names the Attorney General, Prime Minister Dr. Harini Amarasuriya, and the Cabinet as respondents.

The petitioners claim that the MoUs are unconstitutional and violate international law. They argue that the public was not informed about the contents of the agreements, infringing on rights guaranteed by the Constitution.

They further allege that the MoUs threaten Sri Lanka’s sovereignty and territorial integrity and that signing them without presenting them to Parliament constitutes a legal breach.

The petitioners are seeking an interim injunction to halt the implementation of the agreements and request Rs. 2 million in compensation for the violation of their fundamental rights.
